A fight with a bouncer can lead to a personal injury claim

You love going out to dance with friends, and you often go to local bars and nightclubs to do so. Last week, you and a friend went to a local nightclub to meet up with some people you were acquainted with.

During the visit, a small fight broke out between some other people who were there. Trying to be helpful, you and your friend stepped in to break up the fight. By then, it was too late because the bouncers got involved. You tried to explain that you were also trying to help break up the fight, but you ended up getting thrown out after having the bouncer throw, and land, a punch.

You thought that you’d be fine, but you later found out that your jaw was broken. Now, you’re mad at the bouncer’s aggression, and you feel that you’ve been wronged. Have you?

In this case, you may have a right to a personal injury case for the injuries you suffered. Bouncers don’t have a right to use force that is unnecessary against patrons. If you were willing to leave or were not attempting to attack the bouncer, then there was no reason for them to assault you.

There is a fine line between what is and isn’t acceptable in bars and nightclubs when security gets involved. The most important thing is that the security team is restrained and doesn’t use more force than is necessary. If they do, they could seriously harm someone who did not have the intention to harm them. That leads to liability for the club and opens the opportunity for the victim to sue.
