Pltf., a 37-year-old steel worker employed by Third-party Deft., claimed that on 3/31/95 he was working on a scaffold at Riker’s Island, when the scaffold collapsed. Pltf. was hired to help construct new housing units on Ricers Island at the time of the incident. Deft. Space Master was the general contractor and Deft. Besteel Industries was the subcontractor at the construction site. Pltf. claimed that the scaffold, which was provided by Third-party Deft. HFC Erectors, was defective. Pltf. was granted summary judgment on liability pursuant to Labor Law 240.

Injury:
Spondylolisthesis at L5-S1. Pltf. required surgical fusion at the disc site and later had the hardware removed. Deft. would have argued that Pltf.’s injury was pre-existing and that he was malingering.
